Consumers have a statutory right of withdrawal for orders in this shop. We grant it for living plants as well. The instructions and the form follow the statutory models (Annexes 1 and 2 to Art. 246a § 1(2) sentence 1 no. 1 and § 2(2) no. 2 EGBGB).
How to withdraw
At the bottom of every page of our shop you find the button “Withdraw from contract”. It takes you to the withdrawal in two steps: you give your name, the contract (the order number) and your email address and confirm the withdrawal with “Confirm withdrawal”. You then receive a confirmation of receipt from us by email. You can also declare the withdrawal in any other way described below.
Withdrawal instructions
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal you must inform us (Frank Poessel, Malinenstraße 27, 22783 Hamburg, Germany, email: kontakt@succulenttent.store) of your decision to withdraw from this contract by means of a clear statement (for example through the “Withdraw from contract” button in the shop, a letter sent by post or an email). You may use the attached model withdrawal form for this, but it is not mandatory.
To meet the withdrawal deadline it is sufficient that you send the notice of exercising the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract we must reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a type of delivery other than the least expensive standard delivery we offer), without undue delay and at the latest within fourteen days from the day on which we received the notice of your withdrawal from this contract. For this reimbursement we use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees because of this reimbursement.
We may refuse reimbursement until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is earlier.
You must send back or hand over the goods to us (Frank Poessel, Malinenstraße 27, 22783 Hamburg, Germany) without undue delay and in any case within fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods.
You are only liable for any loss in value of the goods if this loss in value results from handling of the goods that was not necessary to check their nature, characteristics and functioning.
Note on returning plants
This note is not part of the statutory instructions and is not a condition for the withdrawal. Please write to us briefly by email before returning, so that we can agree the best way back for the plant with you. We recommend returning the plant carefully packed and, if possible, from Monday to Wednesday so that it does not sit in a parcel over a weekend.
