Terms and conditions

General terms and conditions, as of October 2026

1. Scope

These general terms and conditions apply to all contracts for the purchase of goods between Frank Poessel, Malinenstraße 27, 22783 Hamburg, Germany (the “Seller”) and consumers, concluded through this online shop “Succulent Tent”. A consumer is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to their commercial or self-employed professional activity (§ 13 BGB).

The offer is aimed at customers with a delivery address in the European Union.

2. Conclusion of contract

The presentation of the plants in the shop is not yet a binding offer but an invitation to you to make an offer yourself.

How to order: you put plants in the cart and give your details, the delivery country and the payment method in the order process. On the last page you see all details summarised once more. Until then you can correct input errors at any time by changing the details or going back in the browser. By clicking “Order with obligation to pay” you make a binding offer to buy the plants in the cart.

The contract is concluded when we confirm your order by email (order confirmation). If you pay by PayPal you receive the order confirmation as soon as your payment has reached us; we may confirm that your order has arrived automatically before that, which is not yet an acceptance.

Plants offered as one-of-a-kind exist only once. If the ordered specimen is no longer available, we do not accept your offer. We will then inform you without delay and refund any payments already made without delay.

The contract language is German. We store your order data. You receive the order data and these terms by email; you can also open the terms in the shop at any time.

3. Plants, species protection and care

Living plants are natural products. Growth habit, leaf colour, flowers and size may differ from the photos depending on season and growth. For one-of-a-kind plants the photos show the specimen you will receive.

Plants that are protected under the EU Wildlife Trade Regulation (Regulation (EC) No 338/97, Annex A or B) are sold only with proof of legal origin. The proof is enclosed with the shipment and can be requested at any time. Plants are shipped with a plant passport where the law requires it.

Care notes in the shop are general recommendations. Whether a plant thrives also depends on location and care.

4. Prices

All prices are total prices in euros. As a small business under § 19 UStG we do not show VAT. Shipping costs are added. You see their amount in the order process before you order with obligation. The payment method causes you no additional costs.

5. Shipping and delivery

We deliver only to the countries of the European Union offered in the order process. We ship from Monday to Wednesday so that plants do not sit in a parcel over a weekend. Delivery times and further details are on Shipping and payment.

In frost or great heat we may postpone shipping. We will then get in touch with you.

6. Payment

We offer payment by PayPal (through our payment service provider Mollie) and by bank transfer in advance. You see which payment methods you can choose in the order process.

If you pay by PayPal you pay immediately after ordering. The plants are reserved for you for a short time after the order; if the payment is not completed within this time, the order is cancelled automatically and the plant is offered again.

For payment in advance we give you our bank details, the reference and the payment deadline in the order confirmation. We ship after receipt of payment. If the payment does not arrive within the deadline given, the order is cancelled automatically and the plant is offered again.

7. Retention of title

The goods remain our property until paid in full.

8. Right of withdrawal

As a consumer you have a statutory right of withdrawal. You find the withdrawal instructions and the model withdrawal form under Withdrawal. You can also declare the withdrawal with the “Withdraw from contract” button at the bottom of every page of the shop.

9. Liability for defects

The statutory provisions on liability for defects apply.

Please check the shipment promptly after receipt and report transport damage and defects, if possible within two days, with photos by email to kontakt@succulenttent.store. This is a request so that we can help quickly. Your statutory rights do not depend on it.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee or fraudulently concealed a defect.

For slightly negligent breach of an essential contractual duty (a duty whose fulfilment you may rely on and which characterises the contract) liability is limited to the foreseeable damage typical for this kind of contract. In all other cases liability for slight negligence is excluded.

11. Applicable law, dispute resolution, final provisions

The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.

Should a provision of these terms be invalid, the rest remains valid. The statutory rule applies in place of the invalid provision.
